Two New Diagnostics Must be Provided by Landlords to Tenants

As of January 1, 2018, all French property landlords must provide their renters with a diagnosis of the condition of the domestic gas installations and a diagnostic for the condition of the electrical installations of the dwelling.

These diagnostic reports must be made by a professional who verifies key points of security.

The documents to be provided when signing or renewing the lease and they are only valid for a period of 6 years. This new owner obligation relates to apartments or houses whose facilities are more than 15 years old.

As a renter or landlord confirm the application of this rule to your residence before renting.

New Rule for French Property Landlords

French real estate owners renting their property have a new document they must give as notice to renters when they wish to give notice to tenants to leave.

According to an article in French in Explorimmo here from 1 January 2018, the French property landlord must attach a special information notice to his tenant, if the landlord decides to take back the dwelling to live there or to house a relative or even if he wants to sell the residence.

This new document must indicate the identity and address of the beneficiary of the recovery and specify the relationship between them. As for requesting the tenant to leave so the residence can be sold, this notice at this moment in time can only be issued at the end of the first renewal of the current lease.

French Real Estate Mortgage Insurance Now Renegotiable

When you have a French mortgage you get mortgage insurance and this mortgage insurance can be something you wish to negotiate. Up until recent change was not an option. Now it is official, the French Constitutional Council agrees that right of annual cancellation of all insurance policies by a borrower is in accordance with the law contrary to an appeal by the French banking federation.

As of Friday, January 12, 2018 the decision of the council allows individuals to apply to change their insurance on the mortgage on the anniversary date of the insurance. Note: make sure you confirm these details with your bank and prepare ahead of time.

As quoted in French in Explorimo and translated “all loan insurance contracts, including old ones, can be terminated on the anniversary date and replaced by another, provided that the guarantees are equivalent to the bank’s acceptance of this new contract.

This can offer significant savings to loan holders if the new insurance is at a lower cost per month.
