French New build properties will often display the letters BBC in the advertisements or the phrase Batiment Basse Consommation.

BBC or Batiment Basse Consommation is a new architectural concept using orientation, insulation, choice of materials and more to create a new higher level of energy efficiency to minimize the impact on the environment.

What is the 7 day cooling off period 7 jours de retractation in a French property purchase?

IMPORTANT UPDATE: Change in the law. As of August 2015 the seven day cooling off period is now 10 days. This change came about via the Loi Macron. So substitute 10 for 7 in the details below. Verify with your notary that this law has not changed again after you read this article dated 2014.

When you are buying a French property and you have signed the first contract (compromis de vente / sale and purchase agreement) you are entitled to a seven day cooling off period.

This ‘cooling off period is called in French ‘7 jours de retractation du consommateur’ (Learn details on French government site)

This option to withdraw from the contract is only available to the French property buyer and is not available to the French property seller. The seller is legally bound to the contract once he has signed the ‘compromis de vente’.

There are specific details related to property purchases in France and your right to the seven day cooling off period so we recommend you confirm with your French notary if you have the legal right to have this option.

We have heard it is not available for specific types of purchase and it is not available to French property buyers who are making a purchase vai a SCI (Société Civile Immobilière) or if you are a registered property professional in France. Get legal advice before you sign.

Located in the legendary district of Cannes called Oxford, there was a historical domain that once housed the Congrégation des Soeurs de l’Assomption. It is this location full of nature that ‘Parc Eugénie’ is being built. The name of this luxury French residence was chosen in honour of Mother Marie-Eugénie who founded the Order in 1839.

There are approximately 100 apartments (we say approximately since some are being joined together by buyers to make duplex style apartments.)

Not many are left unsold.
The last time one of the agents we know visited the location there was FIVE apartments left for sale.

The photo below shows the current level of site construction on the first building which is all sold. The second building has just had the foundation started and it is almost sold out. (date of article 2014)

How to Negotiate in a French Real Estate Purchase

When you are buying a French property you will always want to get the price down as much as possible but negotiation is a learned skill. If you are curious here are tips from an English speaking French real estate agent with over ten years of experience.

One
Evaluate the Price
Experienced French property buyers who focus on a particular area will be able to tell right away if a property is negotiable. They will see the signs that a property is overpriced, they will have studied the amount of time the property is on the market, they will see the property has current features that are undesirable but can be changed for the better. Then after they evaluate they know if it is the right property to negotiate a deal on.

Two
Ask
Don’t be afraid to ask the seller if the price is negotiable sometimes they will tell you right away what is the lowest sale price on their French property.

Three
The Price
Before you enter into a negotiation it is important to know the price you wish to pay, the maximum price you can afford and the price that is too much to pay. Don’t’ just hope to get a reduced price compared to the sale price. Then once you have a goal in mind you can see if during the process you can reach your goal.

Four
Be Clear
Be clear in your mind how much you can actually afford to pay for the French property. Make sure your bank is willing to support what is your maximum price to pay. so that you can afford to buy the property once you make your deal.

French Property Rentals can be challenging if you are located overseas and you don’t know the person you are renting from. To avoid being scammed review the excellent list of tips below posted by Explorimmo.

Pricing
When the price is too good to be true, maybe it is. Take a look at the details and be cautious. Keep in mind the following tips.

Two
Verify the Owner
Many advertising websites are just portals of information and they do not verify the advertiser’s details to see if they are the owner. They also may not offer you a secure system for payment. Make sure in advance you get the phone number, address, email etc of the owner. You can verify the owners details in the French Registre du Tribunal de Commerce. If you are renting from an owner start by checking the phone book and a great tip is to mail a letter directly to the owners address and see what kind of response you get. Also consider using an established rental agency and look for letters of reference.

Check Online Forums
Search for details about the French property and French property owner and French rental agency in online Forums like Expat sites or a search engines and also check consumer associations.

Deposit amount
According to the French Hussiers of Justice if the deposit is more than 30 percent this often signals a scam

Five
Payment Method
Make sure you use a method of payment that is secure and if the property is in France be careful if the owner is asking you to send money to a different country.

Six
Request a written rental agreement
Under the laws in France the there must be a written rental agreement created in a duplicate format and signed by all parties. The agreement needs to include details of the French property, the rental dates, all details of costs etc.

Seven
Detailed Inventory
Like in a traditional rental you need to do a walk thru the property with the owner or rental agent and make a list of the condition of the property before and compare at the end of the rental. Make sure you check the reading of the meters for electricity, water etc.

Eight
Problems
Ask for a refund, as a renter you are typically protected by the French consumer code (code de la consummation) this applies to individuals and professionals. Perhaps, a simple discount is in order instead of a refund you decide.

Nine
Serious Problem
If the owner or rental agent does not agree to remedy the problem to your liking then you will need to seek legal advice. Make sure you keep all your documents and records that you will need to prove your case.

Advice
