French Property: How to avoid flood damage

When you are in the process of buying a French property you will receive diagnostics documents from your French notary that include details about the location of the land and the possibility of flooding.  Make sure you check this document so you know and are willing to accept the pending danger.

If you choose to buy a French property that could be flooded consider the following and seek more advice from your local city hall and experts on flooding.

One

When you hear of a pending flood keep your radio tuned to a local news station, if you don’t understand French have a friend who understands French listen to the radio for you and keep you up to date.

Two

If the flooding is unavoidable then shut off all electrical power in your home or apartment. If it is recommened to shut off electrical power even if the possibility of flooding is not guaranteed shut off power immediately.

Three

Make sure that your home or apartment has ways to minimize the potential damage to electrical, gas or fuel heating systems. If you are renovating a home in a potential flood area consider what you can do to avoid potential damage should a flood happen.

Four

Make sure you store any toxic chemicals away from being touched by water to avoid contamination to the environment as a result of water reaching these items.

Five

Respond rapidly to the local emergency advice on the need for you to leave your home. Even if it does not look like your home is going to be flooded you don’t want to take the risk and find out you misjudged the situation by ignoring professional advice.

Six

Avoid driving through flooded areas in your vehicle even if you drive a four wheel drive vehicle because you never know what has happened under the water (crack in the ground…) or what is under the water (bicycles…)

Seven

How much time is there between the signing of the compromis de vente and the Acte de Vente in a French property sale?

In general, in a French property sale there are three to four months between the signing of the compromis de vente and the signing of the Acte de Vente for a re-sale property. The biggest factor on the timing is typically the extra time allowed for a French property purchase when the buyer is purchasing using finance to purchase the property. In addition, if the property involves the buyer getting a building permit more time needs to be added.

The time period above is general and cannot be relied upon. You need to speak with your English speaking French notary and he will tell you how long the time will be in your specific situation.

Can my French building construction permit be cancelled?

One reader asked us about her French real estate project and as to whether her construction permit or building permit could be cancelled after it was issued.

We checked with a English speaking French notary and here is the short answer:

IMPORTANT NOTE: As you know the answers can change from place to place in France and the rules in one place can change. So just read the following as general information and only proceed once you have confirmed details with you notary and your local French city hall.

The notary said:

Once the construction permit has been approved by the French city hall the planning permission has to be posted on the wall beside the French property. Then neighbors can protest against the construction taking place. The neighbors have two months from the date of the posting of the planning permission to protest.

In addition, the city hall who issued the permit has 3 months from the date of issue to cancel the permission they gave in the first place.

If this sounds confusing to you, it does to us as well. We recommend you speak to an English speaking French notary to understand all the details before you start a housing project on your French property.

July 2013, The French real estate market, despite low interest rates and the fact that overall price are down, is still running at slow speed.

OVERALL PRICES ARE DOWN

According to FNAIM, prices continue to fall down 0.7 percent in the last 3 months for all of France. When you compare year to year the prices are down approximately 3.6 percent. Note these are average prices, in places like in Provence-Alpes-Côte d’Azur prices are said to be down 7.6 percent.

MORTGAGE RATES ARE EXCELLENT

Historically low interest rates are on average at 3 percent. This combined with low prices is rare in the French real estate market. Yet, the French real estate buyers are not excited.

According to one poll 38 percent of French people feel it is not the right time to buy and less than 50 percent believe it is a good idea to buy.

UNCERTAINY IN THE FRENCH REAL ESTATE MARKET

62 percent of sellers think conditions are not right to achieve a sale.

It is estimated only 72,000 transactions will take place this year compared to 98,000 last year.

Overall, the market is filled with buyers and sellers who lack confidence.

French Property Fire Safety Preparedness 5 Tips

If you live in France particularly in the south close to wooded area and there is potential for fire due to the high temperatures in the south of France it is an excellent idea to plan how you will respond to a fire.

Here are a few suggestions also seek additional guidance from local French authorities

One

Plan two exit routes from your French house or apartment and make sure you have a meeting point for family members.

French properties don’t always have smoke and fire detectors so make sure you install Smoke and Fire Alarms like these on every floor. (NOTE: make sure the smoke and fire alarms are designed for your French property)  If the power should go out during a fire you may be better off having smoke detectors that are battery powered just make sure you check the power of the batteries on a regular basis, ideally monthly. Then change the batteries every time the clock changes with daylight savings time.

When there is smoke remember to get low and move.

Practice you escape plan each time you change the batteries on your smoke detectors

Five
