Buying a French Villa – FIVE big mistakes to avoid

When you are buying a French Villa  here are five mistakes to avoid:

One

Forgetting to ask the French real estate agent or the French property owner to give you a document that confirms the size of the villa. – unless the villa is in a residence or domain you most likely will not receive any confirmation of the size.

If the size is important to you make sure you request the size of the home is verified as part of your offer. Maybe you don’t mind what size the house is but what if the house burns down and you have a dispute with the insurance company since you cannot prove the size for replacement of your dream French home.

Two

Not confirming the property has access to water and sewer, you may find out to your surprise you are using a well and you have a septic tank to take care of.

Three

Not obtaining a copy of the French plan cadastral showing the parcel of land you want to buy. Worse still, not confirming the details of the plans with the title of the property, the cadastral plan we have heard is not 100 percent reliable. Speak with your English speaking notary about this.

Four

Not going to the French City Hall (Mairie) and consulting the zoning plan for the area for future changes. You might find out part of your garden is part of a new road. Make sure you take with you someone qualified to ask the questions in French you need answered and make note of the responses.

Five

Not obtaining confirmation of the boundaries of the property – what you may  be looking at could be part of the neighbors property, if you are concerned obtain the help of a boundary surveyor.

Six and More

Should I get legal advice before signing a compromis de vente?

When you buy a property in France you will be asked to sign a compromis de vente at the real estate agency or your notary’s office or the office of the notary of the seller, if you have not chosen to have your own notary.

This is a contract you are signing with built in legal obligations. Before you sign this document you need to seek legal advice from a trained independent legal adviser who can explain to you all the details of the contract in words you understand.

Even if you can read French, French legal terminology can be challenging so don’t take any chances.

When you are buying a French property you need to make sure that your interests are protected by getting professional legal advice.

With professional legal guidance during your purchase of a French property you can protect your interests by adding clauses that are to your benefit.

Lead Testing in French Properties: Maybe Cancer Causing

In France, properties for sale or rent must be tested for the presence of lead in the paint and due to a new law in France in 2006 the test for the presence of lead must be below the surface level.

Unfortunately, this deep testing device used to test for lead is a nuclear based device and French diagnostic technicians appear to be getting cancer from using these machines.

There have been several cases of leukemia experienced by French property diagnostic technicians, in fact in the last seven years nine diagnosticians were victims of leukemia or cancer. Four of them have died.

An investigation into the health impact of this lead testing technology has been started.

Corsica French Property Purchases : Potential Restriction for Non-Residents of Corsica

Are you looking to purchase French property that is located in Corsica? This may become a complicated matter if you are not already a resident of Corsica.

In the beautiful island located off the South of France local political official Paul Giacobbi has suggested that restrictions be placed on non-resident purchases to help reduce soaring prices due to speculation by outside investors.

Not everyone is in agreement with this proposal and votes by over 6000 readers on the website of the online French newspaper Le parisen showed over 67 percent of voters were shocked by this proposal.

In there a French MLS real estate system?

In France there is currently no MLS or multiple listing service that contains all the property that are for sale with French real estate agencies.

Many people have tried to create a MLS system here in France but for one reason or another a complete MLS system has not be created.

In addition, most MLS systems in countries like Canada and USA contain properties only for sale with one agency called an Exclusive Listing. In France, at this time less than five percent of property listings are only with one agency. Most properties are for sale with multiple agencies and are therefore not true Exclusive listings.

Worth noting: There are some services that are best described as a mini-MLS services – meaning they are a group of agencies who post their individual Exclusive listings of French real estate properties on one site but these sites do not give you a complete view of the market place. This is because there are only a selection of properties.

Foreign buyers sometimes think they are complete systems due to the association of the name MLS with a complete view of properties in their home country. But unfortunately at this time they are not complete.

In addition, at this time, as a member of the public you do not typically have direct access to these mini-MLS systems you have to deal with an agent who is part of the group to get access.

Overall, there are many sites you will need to visit if you are working without an agent and you may find the same property for sale with different agents and even the owner at different prices so you will need to take your time and study a lot of information and call a lot of agencies in your area of choice.

Solution: The best way to find a property at this time perhaps is for you to connect with a real estate agent who has a really strong network with other agencies in the area you wish to buy.
